Regulations of the online store

§ 1

Preliminary provisions

  1. The SEADOG ALL FOR DOGS online store is available at

  2. These Regulations are addressed to both Consumers and
    Entrepreneurs using the Store and defines the rules for using the Store
    and the rules and procedure for concluding Sales Agreements with the Customer on
    distance via the Store.

§ 2
definitions

  1. Consumer - a natural person concluding a contract with the Seller within the Store,
    the subject of which is not directly related to its business activity or
    professional.

    not being a legal person, to which a separate act grants legal capacity,
    conducting business activity on its own behalf and using the Store.

  6. Distance contract – a contract concluded with the Client within the framework of
    an organized system of concluding distance contracts (within the Store), without
    simultaneous physical presence of the parties, with the exclusive use of one or
    more means of distance communication until the conclusion of the contract

  8. Order - Customer's declaration of intent submitted via the Form
    Orders and directly leading to the conclusion of a Product Sales Agreement
    or Products with the Seller.
  9. Account – customer account in the Store, it collects data provided by
    Customer and information about Orders placed by him in the Store.
  10. Registration form - a form available in the Store, enabling the creation of
    Accounts.
  11. Order form – an interactive form available in the Store enabling
    placing an Order, in particular by adding Products to the Basket and
    specifying the terms of the Sales Agreement, including the method of delivery and payment.
  12. Shopping Cart – an element of the Store software in which the products selected by you are visible.
    Customer Products to purchase, and there is also the possibility of determining and modifying data
    Orders, especially product quantities.
  13. Product - a movable item/service available in the Store that is the subject of the Agreement
    Sales between Customer and Seller.
  14. Sales Agreement – ​​a Product sales agreement concluded or entered into between
    Customer and Seller via the Online Store. By Agreement
    Sales shall also be understood as – in relation to the features of the Product – a contract for the provision of
    services and contract for specific work.

§ 4

Technical requirements

To use the Store, including viewing the Store's assortment and placing an order

  2. The final amount to be paid by the Customer consists of the price for the Product
    and the cost of delivery (including transport, delivery and postal charges),
    which the Customer is informed on the Store's website when placing the Order,
    including at the time of expressing the will to be bound by the Sales Agreement.
  3. In the case of a Contract covering a subscription or provision of services for a period of time
    not marked with the final (final) price is the total price including all
    payments for the billing period.
  4. When the nature of the subject matter of the Contract does not allow, reasonably assessed,
    prior calculation of the final price, information about
    the way the price will be calculated and the transportation charges,
    delivery, postal services and other costs will be provided in the Store
    Product description.

§ 6

Creating an Account in the Store

  1. To create an Account in the Store, you must complete the Registration Form.

  3. Logging in to the Account is done by entering the login and password set in
    Registration form.
  4. The customer has the option to cancel at any time, without giving any reason and without incurring any costs.

§ 7

Order placement rules

In order to place an Order:

  1. log into the Store (optional);
  2. select the Product that is the subject of the Order and then click the "To" button
    basket" (or equivalent);
  3. log in or use the option of placing an Order without registration;
  4. if you have chosen to place an Order without registration, complete the Form
    orders by entering the details of the recipient of the Order and the address to which
    the Product is to be delivered, select the type of shipment (delivery method
    Product), enter the invoice details if they are different from the recipient's details of the Order,
  5. click the “Order and pay” button/click the “Order and pay” button and
    confirm your order by clicking on the link sent in the email,
  6. choose one of the available payment methods and depending on the payment method,
    pay for the order within the specified time, subject to § 8 point 3.

§ 8

Offered delivery and payment methods

  1. The customer can use the following methods of delivery or collection of the ordered goods:
    Product:
    a. Shipment to an InPost parcel locker
    b. Courier delivery
    c. Personal collection is not possible.
  2. The customer can use the following payment methods:
    a. Payment by traditional transfer to the Seller's account
    b. Electronic payments (PayNow)
    c. Payment by card. (Apple Pay, Google Pay, VisaPay).
  3. Detailed information on delivery methods and acceptable payment methods
    are located on the Store's pages.

§ 9

Performance of the sales contract

  1. The conclusion of the Sales Agreement between the Customer and the Seller takes place after
    the Customer has previously placed an Order using the Order Form in
    Online store in accordance with § 7 of the Regulations.
  2. After placing the Order, the Seller immediately confirms its receipt and
    at the same time accepts the Order for execution. Confirmation of receipt

  4. If the Customer has chosen a delivery method, the Product will be
    shipped by the Seller within the time specified in its description (subject to
    paragraph 5 of this section), in the manner chosen by the Customer when placing the order
    Orders.
  5. In case of ordering Products with different delivery times, the delivery time
    delivery is the longest given date.

  6. The start of the period for delivery of the Product to the Customer is counted as follows:

  7. Product delivery takes place within Europe.
  8. Delivery of the Product to the Customer is subject to payment, unless the Sales Agreement provides otherwise.

The right to withdraw from the contract

  7. Effects of withdrawal from the Agreement:
    a. In the event of withdrawal from a Contract concluded at a distance, the Contract shall be deemed
    not concluded.
    b. In the event of withdrawal from the Agreement, the Seller shall return to the Consumer
    immediately, no later than within 14 days from the date of receipt of the statement
    the Consumer about the withdrawal from the Agreement, all payments made by him, in
    including the costs of delivering the goods, except for additional costs resulting from
    a delivery method chosen by the Consumer other than the cheapest standard one
    delivery method offered by the Seller.
    c. The Seller will refund the payment using the same payment methods,
    which were used by the Consumer in the original transaction, unless the Consumer
    he has expressly agreed to a different solution which will not involve any costs for him
    no costs.
    d. The Seller may withhold the refund until receipt of the payment.

    e. The Consumer should return the Product to the Seller's address provided in this
    Regulations immediately, no later than 14 days from the date on which he informed

a. in which the subject of the performance is a non-prefabricated, manufactured item
according to the Consumer's specifications or to satisfy his needs

packaging that cannot be returned after opening the package due to
health protection or for hygiene reasons if the packaging has been opened
after delivery,
c. in which the subject of the performance is an item that is subject to rapid deterioration or

d. for the provision of services, if the Seller has fully performed the service with the express consent

expiry of the deadline for withdrawal from the contract and after being informed by
the Seller about the loss of the right to withdraw from the Agreement,

§ 11

Complaint and warranty

  1. New Products are covered by the Sales Agreement.
  2. In the event of a defect in the goods purchased from the Seller, the Customer has the right
    to make a complaint based on the provisions on warranty in the Civil Code. If

    § 12

Out-of-court complaint consideration and redress methods

  2. The consumer has the following exemplary possibilities of using
    out-of-court methods of handling complaints and pursuing claims:

a. The consumer is entitled to refer to a permanent arbitration court
consumer, referred to in Article 37 of the Act of 15 December 2000 on
Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request for
resolving a dispute arising from the Agreement concluded with the Seller.
b. The consumer has the right to contact the provincial inspector of the Inspection
Handlowa, in accordance with Article 36 of the Act of 15 December 2000 on the Trade Inspection
(Journal of Laws of 2014, item 148, as amended), with a request to initiate the proceedings
mediation regarding the amicable settlement of the dispute between the Consumer and
Seller.
c. The consumer can obtain free assistance in resolving a dispute between
him and the Seller, also using the free assistance of the district (municipal)
consumer ombudsman or social organization whose statutory tasks include
consumer protection (including the Consumer Federation, the Association
Polish Consumers).

§ 12

Personal data in the Online Store

  1. The administrator of Customers' personal data collected via the Store
    online is the Seller.
  2. Customers' personal data collected by the administrator via the Store
    are collected for the purpose of executing the Sales Agreement, and if the Customer agrees to this
    consent – ​​also for marketing purposes.
  3. The recipients of personal data of the Online Store customers may be:
    a. In the case of a Customer who uses the delivery method in the Online Store
    by post or courier, the Administrator provides the collected data
    the Customer's personal data to the selected carrier or intermediary carrying out
    shipments on behalf of the Administrator.
    b. In the case of a Customer who uses the payment method in the Online Store
    electronic or payment card, the Administrator provides the collected personal data
    The Customer, the selected entity handling the above payments in the Store

  4. The customer has the right to access their data and correct them.
  5. Providing personal data is voluntary, however failure to provide the data indicated in
    Regulations on the processing of personal data required to conclude a Sales Agreement shall result in
    the impossibility of concluding this agreement.
    § 13

Miscellaneous

  1. Agreements concluded through the Online Store are concluded in Polish.
  2. The Seller reserves the right to make changes to the Regulations for important reasons.
    reasons, i.e.: changes in legal regulations, changes in payment and delivery methods – in the scope,
    to what extent these changes affect the implementation of the provisions of these Regulations.
    The Seller will inform the Customer about the change at least 7 days in advance.
  3. In matters not regulated in these Regulations the following shall apply:
    generally applicable provisions of Polish law, in particular: the Civil Code;
    Act on the provision of services by electronic means; Act on consumer rights, Act on
    protection of personal data.
  4. The customer has the right to use out-of-court complaint resolution methods and
    to pursue claims. To this end, you can file a complaint via the EU platform
    ODR website available at: http://ec.europa.eu/consumers/odr/.
